WORK DETAILS ELLABORATED BELOW:-

  • The Authority has adopted a single stage two-part system (referred to as the “Bidding
    Process”) for selection of the Bidder for award of the Project. Under this process, the
    bid shall be invited under two parts. Eligibility and qualification of the Bidder will be
    first examined based on the details submitted under first part (Technical Bid) with
    respect to eligibility and qualifications criteria prescribed in this RFP (the “Bidder”,
    which expression shall, unless repugnant to the context, include the members of the
    Joint Venture). The Financial Bid under the second part shall be opened of only those
    Bidders whose Technical Bids are responsive to eligibility and qualifications
    requirements as per this RFP.
    GOI has issued guidelines (see Annexure VII of Appendix-IA of RFP) for
    qualification of Bidders seeking to acquire stakes in any public sector enterprise
    through the process of disinvestment. These guidelines shall apply mutatis mutandis to
    this Bidding Process. The Authority shall be entitled to disqualify any Bidder in
    accordance with the aforesaid guidelines at any stage of the Bidding Process. Bidders
    must satisfy themselves that they are qualified to bid, and should give an undertaking
    to this effect in the form at Appendix-IA.
  • The Bid shall be valid for a period of 120 days from the date specified in Clause 1.3
    for submission of BIDs.
  • The Bidders shall make online payment towards cost of RFP document of Rs. 25,000/-
    (Rupees Twenty-Five Thousand only) through SBI payment gateway which can be
    accessed through https://mahatenders.gov.in and also upload online payment receipt of
    the same.
  • BIDs will be evaluated for the Project on the basis of the lowest cost required by a
    Bidder for implementing the Project (the “Contract Price”). The total time allowed for
    completion of construction under the Agreement (the “Construction Period”) and the
    period during which the Contractor shall be liable for maintenance and rectification of
    any defect or deficiency in the Project after completion of the Construction Period (the
    “Defect Liability Period”) shall be pre-determined, and are specified in the draft
    Agreement forming part of the Bidding Documents.
  • Generally, the Lowest Bidder shall be the selected Bidder. In case such Lowest Bidder
    withdraws the bid or does not submit the performance security or is not selected for
    whatsoever reason except the reason mentioned in Clause 2.1.12 (b) (4), the Authority
    shall annul the Bidding Process and invite fresh BIDs.

WORK DETAILS ELLABORATED BELOW:-

3.1.1 Subject to and on the terms and conditions of this Agreement the Contractor shall undertake
the survey, investigation, design, engineering, procurement, construction, and operation
&maintenance of the Plantation Project and observe, fulfil, comply with and perform all its
obligations set out in this Agreement or arising hereunder. Special attention shall be paid
to the aesthetics of all the project components as per the relevant provisions of IRC codes.
3.1.2 The Contractor shall comply with all Applicable Laws and Applicable Permits (including
renewals as required) in the performance of its obligations under this Agreement.
3.1.3 Subject to the provisions of Clauses 3.1.1 and 3.1.2, the Contractor shall discharge its obligations in accordance with Good Industry Practice and as a reasonable and prudent
person.
3.1.4 The Contractor shall remedy any and all loss or damage to the Plantation Project from the
Appointed Date until the end of the Construction Period and the Operation & Maintenance
period of 5 years at the Contractor’s cost, save and except to the extent that any such
loss or damage shall have arisen from any default or neglect of the Authority.
3.1.5 The Contractor shall remedy any and all loss or damage to the Plantation Project during
the Defects Liability Period at the Contractor’s cost to the extent that such loss or damage
shall have arisen out of the reasons specified in Clause 17.3.
3.1.6 The Contractor shall remedy any and all loss or damage to the Plantation Project during
the Operation Maintenance Period at the Contractor’s cost, including those stated in
Clause 14.1.2, save and except to the extent that any such loss or damage shall have arisen on account of any default or neglect of the Authority or on account of a Force Majeure Event.
3.1.7 The Contractor shall, at its own cost and expense, in addition to and not in derogation of its obligations elsewhere set out in this Agreement:
(a) Make, or cause to be made, necessary applications to the relevant Government Instrumentalities with such particulars and details as may be required for obtaining
Applicable Permits set forth in Schedule-F and obtain and keep in force and effect such Applicable Permits in conformity with the Applicable Laws;
(b) Procure, as required, the appropriate proprietary rights, licenses, agreements and
permissions for Materials, methods, processes and systems used or incorporated into the Plantation Project;
(c) Make reasonable efforts to maintain harmony and good industrial relations among
the personnel employed by it or its Sub-contractors in connection with the
performance of its obligations under this Agreement;
(d) Ensure and procure that its Sub-contractors comply with all Applicable Permits and
Applicable Laws in the performance by them of any of the Contractor’s obligations
under this Agreement;
(e) Not do or omit to do any act, deed or thing which may in any manner be violative of
any of the provisions of this Agreement;
(f) support, cooperate with and facilitate the Authority in the implementation and
operation of the Project in accordance with the provisions of this Agreement;

(h) Keep, on the Site, a copy of this Agreement, publications named in this Agreement,
the Drawings, Documents relating to the Project, and Change of Scope Orders and
other communications given under this Agreement. The Authority’s Engineer and
its authorized personnel shall have the right of access to all these documents at all
reasonable times;
(i) cooperate with other contractors employed by the Authority and personnel of any
public authority; and
(j) Not interfere unnecessarily or improperly with the convenience of the public, or the
access to and use and occupation of all roads and footpaths, irrespective of
whether they are public or in the possession of the Authority or of others.

WORK DETAILS ELLABORATED BELOW:-

  • The Contractor shall ensure that the personnel engaged by it or by its Sub- contractors in
    the performance of its obligations under this Agreement are at all times appropriately
    qualified, skilled and experienced in their respective functions in conformity with Good
    Industry Practice. The said personnel shall never claim to be employees of the
    Authority.
    3.4.1 The Authority’s Engineer may, for reasons to be specified in writing, direct the Contractor
    to remove any member of the Contractor’s or Sub- contractor’s personnel. Provided
    that any such direction issued by the Authority’s Engineer shall specify the reasons for
    the removal of such person.
    3.4.2 The Contractor shall on receiving such a direction from the Authority’s Engineer
    order for the removal of such person or persons with immediate effect. It shall be the
    duty of the Contractor to ensure that such persons are evicted from the Site within 10
    (ten) days of any such direction being issued in pursuance of Clause 3.4.2. The Contractor
    shall further ensure that such persons have no further connection with the Works or
    Operation & Maintenance under this Agreement. The Contractor shall then appoint (or cause
    to be appointed) a replacement.
  • The Contractor shall bear full risk in, and take full responsibility for, the care of the
    Works, and of the Materials, goods and equipment for incorporation therein, from the
    Appointed Date until the date of Provisional Certificate (with respect to the Works
    completed prior to the issuance of the Provisional Certificate) and/or Completion
    Certificate (with respect to the Works referred to in the Punch List), save and except to
    the extent that any such loss or damage shall have arisen from any default or neglect of the
    Authority.
